Terms of Service

By registering or using OvrLayAi (the "Service"), you accept these Terms and our Privacy Policy. We may update these Terms from time to time; your continued use after changes are posted constitutes acceptance of the updated Terms.

• You must be at least 13 years old (or the minimum age required in your country) to use the Service. Users under 18 require parental or guardian consent.
• You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
• You agree to provide accurate information and to notify us of any unauthorized use of your account.

OvrLayAi produces AI-generated animated HTML overlays. Each generation consumes credits, which you obtain through free promotions, one-time credit packs, or monthly subscriptions.

• Free signup or promotional credits may be offered at our discretion and may be changed or discontinued at any time.
• Credit packs are one-time purchases of a fixed number of generations. Unused credits do not expire unless stated otherwise.
• Subscriptions grant a monthly credit allowance and, on paid tiers, the ability to download overlay HTML locally for self-hosting.
• Subscriptions auto-renew monthly until you cancel. You can cancel at any time to stop future renewals; cancellation does not refund the current billing period.
• Credits have no cash value, are not currency, and may not be transferred, sold, or exchanged between accounts.

• We grant you a non-exclusive, worldwide, royalty-free, non-transferable license to use, display, and — where your plan allows — download and self-host the overlays you generate for your own streams and channels.
• You may use overlays in commercial broadcasts of your own content. You may not resell, sublicense, or redistribute generated overlays as standalone templates or products.
• You retain ownership of the inputs you provide (such as your gamertag, social links, and prompts). The generated output is licensed to you under these Terms.

• Overlays are produced by AI and may occasionally produce unexpected, inaccurate, or lower-quality results. We do not guarantee any specific output.
• AI output may resemble content generated for other users; similarity to another user's overlay is possible and does not imply infringement.
• You are responsible for reviewing generated overlays before using them commercially. We are not liable for the content of your overlays.

You agree not to:

• Generate content that is unlawful, infringing, harassing, hateful, or sexually explicit.
• Use prompts or reference images that reproduce copyrighted characters, logos, or brands without the rights to do so.
• Reverse-engineer, scrape, or attempt to extract our models, prompts, or internal systems.
• Resell, share, or transfer your account or credits, or automate generation beyond normal personal use.
• Circumvent credit, subscription, or plan limits.

To keep OvrLayAi safe, we screen content both before and after generation:

• Pre-generation scan. Before any overlay is generated, your inputs (overlay name, prompt, gamertag, subtitle, and stream type) are checked against a keyword blocklist covering sexual content, copyrighted brands, profanity, hate speech, violence, harassment, and illegal activity. A blocked request is refused and no credits are charged.
• Post-generation review. Every overlay carries a moderation status. New overlays that pass the scan are auto-approved and visible in the public showcase. Overlays flagged for review, rejected, or removed are hidden from the public gallery but remain visible to their owner in the private library.
• Reporting. Anyone can report a public overlay using the Report button on its showcase card. Reports are reviewed by our moderation team.
• Takedowns. We may remove any overlay we believe violates these Terms or the Acceptable Use section above.

We enforce a three-strike policy for confirmed content violations. A "strike" is recorded only when an admin resolves a content report by removing one of your overlays — automated keyword blocks do not count as strikes.

• First strike — warning. Your overlay is removed and you receive a warning. Your account remains active.
• Second strike — 30-day suspension. Your account is suspended for 30 days. During the suspension you cannot generate new overlays. The suspension lifts automatically once the 30 days pass.
• Third strike — permanent termination. Your account is permanently terminated, all of your overlays are removed from public view, and you are banned from creating a new account.
• Appeals. If your account is suspended or terminated, you can submit an appeal from the banner on your Generate or Library page. Our moderation team reviews appeals and can reinstate accounts when appropriate.

• Payments are processed by Base44 Payments (Wix). We do not store your full card details.
• You authorize recurring charges for active subscriptions until you cancel them.
• Prices are shown in USD unless otherwise indicated and may change; applicable taxes may apply.

Because overlays and credits are digital goods delivered instantly, refunds are limited. Please see our Refund Policy for full details on credit packs, subscriptions, and how to request a refund.

• OvrLayAi, its brand, code, and design are our property. These Terms grant you no rights to our trademarks or the Service itself.
• Third-party game and content names referenced in vibes or themes are trademarks of their respective owners, used for descriptive purposes only. We are not affiliated with or endorsed by them.
• We respect intellectual property and may remove content we believe is infringing.

Overlays are designed for use in OBS and similar broadcast software; we are not responsible for the behavior of third-party software. Reference images and logos you upload must be yours or properly licensed for use.

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that overlays will be error-free, uninterrupted, or fit for any particular purpose.

• To the maximum extent permitted by law, OvrLayAi and its operators are not liable for indirect, incidental, or consequential damages, or for loss of revenue, data, or profits arising from your use of the Service.
• Our total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold us harmless from claims arising out of your use of generated overlays, your content, or your violation of these Terms or third-party rights.

We may suspend or terminate your account for violations of these Terms. You may delete your account at any time from your account settings, which removes your overlays and personal data.

We may revise these Terms; material changes will be posted on this page. Continued use of the Service after changes are posted constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. We will attempt to resolve disputes informally; unresolved disputes will be resolved in the courts located in Delaware.
